Eurocal Collision: Frequently Asked Questions

What should I do if the other driver does not have insurance?

Answer:

If the other driver caused the accident, you are free to use your own insurance. However, in order to do so, you must have uninsured motorist coverage to make this claim. This coverage may also be used if the other driver does not have enough insurance coverage to cover the entire claim.

If you do not carry uninsured motorist coverage, you have the right to consult legal counsel and pursue a lawsuit against the responsible party. Regardless, in most situations, your auto insurance should cover all costs (less your deductible).

My insurance company is telling me to go to their “preferred” shop. Do I have to?

Answer:

No. You have the right to take your car to an auto body shop of your choice. In fact, it is illegal for an insurance company to force you to a specific auto repair center. Many times, the insurance company will have a “preferred” shop that they work with. This commonly means that they have a contract with that shop that lowers the cost to the insurance company. This does not mean that the work will be better by going to the “preferred” shop. You have every legal right to take your car to the auto body shop that you trust to do the repairs right the first time.
